The following Terms and Conditions set out how you may use the VICAP (Visual Integration CAPTCHA) products and the terms of service offered by MRB Corporation Limited.

By using the VICAP (Visual Integration CAPTCHA) services and Our site you are confirming that you accept these terms and conditions, the incorporated policies and that you agree to abide by them.

1. Definitions of Services

a. VICAP (Visual Integration CAPTCHA) is a trading name and a product of MRB Corporation Ltd.

b. Wherever used, ‘We’ or ‘Us’ shall mean MRB Corporation Limited and ‘You’, ‘the User’ or ‘the Customer’ shall mean the VICAP end-user or customer.

c. MRB Corporation Limited incorporated in the England and Wales under company registration number: 11415351

d. VICAP is not an antivirus product and offers no protection of this nature. Used correctly, VICAP provides protection for your website against online automated computer robots also known as bots.

e. VICAP provides no guarantee that no virus or harmful information can access your server or website.

f. VICAP is intended to protect your website but can not guarantee to protect fully against all kind of attacks which may include bot attacks, Artificial Intelligence Attacks or Optical Character Recognition attacks.

g. VICAP has been thoroughly tested and validated under independent laboratory conditions. All of the test results are available for information and academic/research purposes and are relative to the tests conducted. The tests do not offer any assurance of 100% accuracy under any future identical scenarios conducted.

h. Our servers used to store personal customer data are located in the UK and within Europe.

i. Our email server is located within a USA site which is fully compliance with GDPR Regulations.

j. No personal information is stored on our email server with the exception of any customer enquiries and customer email addresses.

2. Terms of Use

By using www.vicap-cyber.com or www.myvicap.com you agree to be legally bound by these terms of use. These terms of use shall take effect immediately upon your first use of VICAP-cyber.com. Accessing the site implies agreement of all terms and conditions laid out herein. You should leave the site if you do not agree with the specified terms and conditions in relation to www.vicap-cyber.com or www.myvicap.com.

MRB Corporation Ltd. reserves the right to change these terms at any time without giving any prior notice, by posting changes online. Existing customers will be notified of any changes we make but it remains the responsibility of customers to regularly review these terms and conditions for amendments. By using the www.vicap-cyber.com or www.myvicap.com sites you are agreeing with the terms and conditions in place at that point in time. Please review these terms regularly to ensure you are aware of any changes made by MRB Corporation Ltd. Your continued use of www.vicap-cyber.com or www.myvicap.com after changes are posted means you agree to be legally bound by any additional, updated or amended terms within this agreement.

3. Registration of VICAP Services

To use the VICAP Service, the User is required to create a user account on VICAP’s website at www.vicap-cyber.com or www.myvicap.com. Upon creating a user account, a profile shall be generated which will require the User to supply basic information. This information shall be protected as defined in this agreement and shall not be shared with any third party organisations. Amendments may be added to the profile by accessing your profile at a later point in time.

In order to create an account, the User is required to create a 6 digit user ID number and a valid email address. These details shall be cross referenced against VICAP’s internal database to ensure there are no duplicate accounts.

Additional measures are required to ensure your account is secure via a secondary email validation system to complete your registration. After completing the signup page you will receive an automated email from VICAP to confirm your email address. You will then be required to click on the link and confirm your email address. It is only upon completion of this entire process that registration is deemed to be complete and access granted to the use of our services. By completing the registration process, the User is giving express permission for VICAP to store and use their personal data on our database according to our Privacy Policy.

4. Use of vicap-cyber.com or myvicap.com

You may only use the services of VICAP as laid out within this agreement and for the intended purposes only. You may not copy, reproduce, republish, download, post, transmit, make available to the public, or otherwise use www.vicap-cyber.com or www.myvicap.com content in any way except for your own personal and non-commercial use. You also agree not to adapt, alter or create any derivative work from any www.vicap-cyber.com or www.myvicap.com content except for your own personal and non-commercial use. Any other use of www.vicap-cyber.com or www.myvicap.com content requires the prior written permission of MRB Corporation Ltd. Any deviation from the intended terms and conditions is a breach of use and should be discontinued immediately. Whilst written permission is being obtained, all usage must comply with the terms and conditions in place at that point. You agree to use www.vicap-cyber.com or www.myvicap.com only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of www.vicap-cyber.com or www.myvicap.com. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of interaction within www.vicap-cyber.com or www.myvicap.com.

5. Using of API

In order to provide the analytics of your site, VICAP uses tools and API to analyse and keep records of the end user or client’s location and other statistics. Information collected under this function includes but is not limited to IP address, location, operating system, types of web browser, and other analytical and statistical information. None of this information will be used to identify the end user nor to reveal any of their personal data. The analytical tools are provided to establish the nature of your clients or users and how they interact with your website in order for you to improve your services. These API tools can also help you to identify the location and nature of possible threats and bot attacks to your website.

We use third party PADDLE.NET to collect information regarding end users IP address. The accuracy of the information provided by the Paddle is not guaranteed and can be false sometime. For more information please visit their www.PADDLE.NET

We also use API to convert currency on www.myvicap.com The rates of the currency may vary from your local currency exchange borough and will depend on the market. The currency exchange API shows you the prices in American Dollars and GBP. The exchange rate is visible and at no point claims to be the lowest possible exchange rate.

6. Subscription

a) VICAP services are provided on an online paid fee subscription basis. In order to use our online subscription and statistical tools you will need to install a VICAP widget on your website.

b) VICAP subscription packages vary according to the amount of traffic and number of hits to your website.

c) We define a hit as a request from your website where the VICAP widget is installed on to our secure server to display one captcha on your website. Whether this request is coming from a legitimate human or a computer robot (known as bots) it is treated as one hit. If a new challenge or VICAP needs to be displayed on your website, another hit to your account will occur. This includes when the user or bot clicks the “refresh” button to get a new challenge or a new VICAP.

d) Your current package is calculated based upon the total number of hits (humans visitors plus bot attacks) to your website regardless of whether they could pass the test or not.

e) The total number of hits to your site as well as list of all human users and computer bot attacks can be viewed and downloaded via the dashboard function on www.myvicap.com.

f) We will regularly monitor your usage and the number of the hits to your website to ensure you will always pay for what you use and are subscribed to the correct package for your needs.

g) Our system will check the total number of hits from month to month and will subscribe you to the package based upon your current total number of hits to the particular website where the VICAP widget is installed.

h) Each user can have multiple webpages (URL) and will need to create a VICAP widget for each webpage (URL). Each webpage (URL) will be treated individually and the subscription package will be based upon each distinct webpage (URL) and not per user.

i) You may not create two VICAP widgets for the same URL or web page.

j) You may not place the same VICAP widget onto two different URLs or webpages. Each VICAP widget shall be created with the intention of protecting only one URL or webpage.

k) If your current website’s traffic and usage changes, your subscription plan will be adjusted automatically for the upcoming subscription period.

l) If your current usage and total number of hits to your website increases, we will upgrade your subscription package to a higher tariff and subscription plan automatically from the next subscription period.

m) If your current usage or traffic decreases, your subscription plan will be downgraded automatically from the next subscription period.

n) If you choose to pay on a monthly payment method, your website traffic will be monitored throughout the month and will be automatically adjusted to the closest tariff from the next coming month or subscription period. If the traffic or usage of your website increases, we will change your tariff to the higher subscription package for the next coming month. However, if the traffic to your website decreases during the month, we will change your subscription to the lower package for the coming month, but you will not get a refund for the remainder of the current month or current subscription period.

7. Automatic Monthly Renewal

a. Your subscription is set to “automatically” renew each calendar month until you deactivate your site. Until you do not deactivate the site, your plan will be automatically renewed on monthly bases.

b. Provided that automatic renewals are allowed in yourcountry, we will inform you by email before automatically renewing your Services. Once we have informed you that theServices will be automatically renewed, we may automatically renew your Servicesand charge you according to the current usage and package price for the renewal term.

c. We will also remindyou that we will bill your chosen payment method for the Services renewal,whether it was on file on the renewal date or provided later. We will also provideyou with instructions on how you may cancel the Services. You must cancel theServices before the renewal date to avoid being billed for the renewal.

d. You can deactivate your plan at any point without any extra charges by going to www.myvicap.com. However, you are required to pay until end of that monthly period.

e. If you select to deactivate your site, you will not be charged from the next coming up moth and your plan with all its features will be stop automatically after the expiry date.

f. Your renewal date will be the anniversary of the date you registered with VICAP. Each account holder can create multiple VICAP accounts for multiple webpages and for each webpage (URL) you can have a different renewal date. For example, if you registered with VICAP on 1st July then the next payment is due by 1st August.

g. If the payment due date falls upon a weekend or bank holiday, your payment will be taken on the following working day.

8. Free Trial Period

a. We provide a Ten-day free trial for each new VICAP you create. This is to measure the traffic and number of hits to that webpage (URL) to give you an estimation analysis of your monthly plan. This will provide the basis of “current” usage and traffic to your website and shall dictate the subscription package applicable to you. For the information on our pricing packages and subscriptions, you can visit our website at www.vicap-cyber.com/pricing

b. Upon registering with VICAP, the total number of hits to your website will be monitored for the first seven days out of your ten-day free trial. The total number of hits during this seven-day period shall be used to ascertain the estimated usage for the whole month. You shall be presented with this information after the expiry of the seven days and given three days to consider the service and either terminate the service or set up a payment method. In total, you will have ten completely free trial days of VICAP usage on your website.

c. During your ten-day free trial, you will be given a subscription package summary based on the estimated monthly figure.

d. Before the end of your ten-day free trial, we will send you an email reminder to complete your payment in order to continue using the VICAP widget on your website. If no payment is received before the expiry of the free trial, the VICAP widget will be removed automatically from your website and you will not be able to use VICAP and its security features on your site until you complete the purchase.

e. In the case of late payment or declined payment the VICAP will be removed from your website and all the security and statistical features will be removed and disabled from your website.

f. The purpose of the ten-day free trial is to establish the suitability of the services provided by VICAP. This period is sufficient to assess whether VICAP and the suggested subscription package are a fit for your needs. Where our product is not suitable for your needs you will not be expected to enter into the paid subscription period. Entering into a payment arrangement indicates that you have established that VICAP is suitable for your needs.

9. Online Statement and Errors

VICAP will provide you with an online billing statement using you online portal system at www.myvicap.com, where you can view and print your statement. This is the only billing statement that we provide. A VAT invoice may be available. If we make an error on your bill, we’ll correct it promptly after you tell us ﴾or we notice it﴿ and we investigate the charge. You must tell us within 120 days after an obvious error first appears on your bill. If you don’t tell us within that time, you release us from all liability and claims of loss resulting from such error caused by slight negligence; further in that case we won’t be required to correct the error.

10. Disclaimers and Limitation of Liability

a. www.vicap-cyber.com and www.myvicap.com content, including the information, names, images, pictures, logos and icons regarding or relating to MRB Corporation Ltd, its products and services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

b. Under no circumstances will MRB Corporation Ltd. be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise):

i. loss of data;
ii. loss of revenue or anticipated profits;
iii. loss of business;
iv. loss of opportunity;
v. loss of goodwill or injury to reputation;
vi. losses suffered by third parties; or
vii. any indirect, consequential, special or exemplary damages arising from the use of VICAP-cyber.com regardless of the form of action.

c. MRB Corporation Ltd. does not warrant that functions contained in www.vicap-cyber.com or www.myvicap.com content will be uninterrupted or error free, that defects will be corrected, or that www.vicap-cyber.com or www.myvicap.com or the server that makes it available are free of viruses or bugs.

11. Account Deletion and Suspension

Should a user wish to cease using our services, they may delete their account manually via the user portal account or they may request that our support team deletes their account. By deleting the user account, all of the personal information associated with that user shall be blocked and held in a secure and isolated folder in our system for a certain period of time where it will then be wiped from our server permanently.

We hold the data associated with the user for a period of time according to our privacy policy for the purpose of fraud and online crime prevention and money laundry purposes. The user will no longer have access to their data and services after the account deletion.

All of the security features as well as the statistics associated with VICAP will be removed from your site and you will no longer be able to use VICAP on your website with immediate effect. If you delete your account any funds remaining on your account or any remaining subscription shall not be refunded to you and you will lose your subscription.

12. Complaints Procedure

In the event that you are dissatisfied with our service please raise a support ticket for the attention of our support team via your online portal and we will endeavour to address your concerns. Should this not resolve your query and you wish to complain formally, please put your complaint in writing and send to our address as provided in the contact details of our website.

Upon receipt of your written complaint, We will investigate the details of your complaint and endeavor to reach a resolution within 28 days. Please note that unless it is established that MRB Corporation Limited are at fault and have failed to meet our service obligations, there shall be no refunds provided. The purpose of the ten day free trial is to establish the suitability of the services provided by VICAP. This period is sufficient to assess whether VICAP and the suggested subscription package are a fit for your needs. Where our product is not suitable for your needs you will not be expected to enter into the paid subscription period. Entering into a payment arrangement indicates that you have established that VICAP is suitable for your needs.

13. Customer Referral Programme

We have introduced a Customer Referral Programme in order to promote our services and VICAP to new customers. By promoting VICAP to other customers you can earn money when they come on board. This same process will apply if you choose to subsequently set up multiple VICAP subscriptions.

In order to be eligible for the CRP programme you must:

a. Be registered on our website www.myvicap.com and currently be an active VICAP customer.

b. You cannot refer yourself.

c. The referred customer must register on our website and must pay for at least two consecutive months of a subscription packagein order to be eligible.

d. You may claim your CRP commission fee after the referred customer has paid for two full consecutive months of their subscription package. The value of the“First” month subscription will be paid directly to your account.

e. The amount of CRP commission shall be paid to the same method of payment as you may have on your account. We will only pay the commission charge to a different payment type if the current registered method of payment is not valid or expired.

f. We will only pay the CRP commission to the same user (referral) registered on our system.

g. The CRP commissioncannot be transferred and moved to a different user or customer.

h. The amount of CRP commission is equivalent only to the first month subscription fee of the recommended customer and excludes taxes and VAT.

i. The CRP commission is payable only once for each new referred customer.

j. VICAP would take all the necessary security and authentication methods to make sure that the CRP is genuine, and We shall reserve the right no to pay any commission if we realize that the user was intending to cheat on this scheme. We hall reserve the right not to provide any proof or feedback of our internal investigations for security and privacy reasons.

14. Intellectual Property

a. VICAP (Visual Integration CAPTCHA) is a trading name and a product of MRB Corporation Ltd.

b. The names, images and logos identifying MRB Corporation Ltd. or third parties and their products and services are subject to copyright, design rights and trademarks of MRB Corporation Ltd. and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, design right or copyright of MRB Corporation Ltd. or any other third party.

c. Under no circumstances may this product, it’s concept or any element of it be copied or used for any purpose other than those defined within this agreement.

15. Governing Law

These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these terms and conditions or their subject matter or formation (including non-contractual disputes or claims).
